Resolution to the Excal / Riffex Case

It's been almost 6 months now, but we're finally done. Excal's court case for identify theft was this morning. For those of you not in the know the TL;DR is that Excal (currently known as Riffex or @RiffexSL) was staying at my apartment with myself and Wizzy during Glitch 7, and he stole my credit card numbers one night and then ordered about $150 worth of stuff in the following days before I caught wind of what was going on and cancelled everything I had. My previous write-up can be found here*: https://www.twitlonger.com/show/n_1sr142f

*There is one small correction to the above. The Uber charge turned out to be from UberEats. Turns out that during the initial charge it's listed as Uber.com but after it fully processes to your card it's listed as UberEats. Additionally I had to take down a screenshot or two because someone pointed out I missed an address line.

Excal was up on 11 charges, mostly all misdemeanors for petty theft of under $100. A guilty plea was entered for one count (#8)* for the Amazon charges and the rest were dropped or suspended. His sentence was as follows:

1 Year of Supervised Probation
40 Hours of Community Service
No Contact order w/ myself
Assorted Court Fees

While I'm glad this is all finally over and I can move forward, I'm more upset that this all could have been avoided. I don't know why Excal thought this was okay and I'm not really gonna get a real answer at this point. I messaged him in private when I first found out about the fraudulent charges, and he denied it multiple times and continued to do so once I blocked him and made my grievances public.

It was only after I said I was going to the police that I got these messages from him through a mutual friend: https://imgur.com/a/BHiy62k

Now I want you to take a good read of the above. This reads to me less like "I'm sorry" and more like "I'm sorry I got caught". We still haven't gotten any public acknowledgement of any wrongdoing, it's all been swept under the rug.

Twitter already knows way more than they need to? Want to know how to keep Twitter from finding out you're a thief? DON'T STEAL SHIT. Everything about that message (which I got while I was at the police station, which only pissed me off more) reeks of "Please I just can't let everyone know or I'll lose my clout/credibility/etc". Even after I had lent him money to enter The Grind before Glitch and make sure he could eat that weekend (he claimed to have forgotten his wallet at home), he still had the gall to do something like this. What gets me the most is that I got lucky in catching him when I did. I realize I may be somewhat well off, but I spend my money on more than just myself. My old man has been out of work on disability for about 10 years and struggles to make ends meet, so it falls upon me, his oldest son to help him keep the roof over his and my sister's head because the two of them are the most important things in the world to me. So when you steal from me, you're not just taking MY money but you're placing the well being of my family in danger as well.

The explanation about it being fine as long as he used it for "small" purchases here and there and spent his own money on other things just confuses the hell out of me. Is that really how you justify taking what you clearly acknowledge isn't yours?? Things could have gotten so much worse if I hadn't caught it when I did and he could have decided to get bold and start using my cards for way more expensive stuff.

There's a lesson to be learned here about trusting folks, and I'll certainly be more careful in the future. If there's any further clarification/proof anyone needs feel free to contact me directly. More importantly, there's another lesson here about the whole "He's too nice to have done that" narrative. How many times are we gonna fall for that? The number of people who kept defending him with that was astounding. If you wanna believe him because it was a case of my word vs his and the laws kept me from getting conclusive evidence, sure. That's fine and I can't fault you for that. But if your defense is "He donated 1k to Nairo once why would he do that" (someone actually did this) then the only thing I can tell you is that donating large chunks of money to streamers is probably about climbing social ladders and in no way excludes you from the possibility of being a thief, as has been demonstrated. He's probably been really nice to a good number of you I'm sure, but the fact remains that "nice" people can, and probably will continue to, do terrible shit.

Thank you all for your patience in the matter. I know a lot of people kept wondering what was going on with this but I felt like continuing to post about it while the court case was still pending would just be pointless harassment and it'd be better to just wait until things were settled in court so it was no longer a case of my word against his.
