Gamespot made a short video about John Romeros new DOOM level, took the footage from Ultraboy94fsr and didnt credit him for it - (Gamespot vid) https://www.youtube.com/watch?v=_02KAc24yPg - (Original) https://www.youtube.com/watch?v=PouzO1ch4Z0 - That isn't kosher. For gameplay without commentary, especially when you only use parts of it, you can absolutely argue fair use. We use other peoples gameplay in some videos, but the cardinal rule is CREDIT THE PERSON. Sure, you can argue that the gameplay without any commentary really doesn't belong to the person, you're just using assets from the game which belongs to the developer, but if you also believe Lets Play is inherently transformative and someones gameplay is their own work, don't be a dick and credit them for use of the footage. We generally only use footage from other Polaris channels, though rarely we'll pop up footage from someone elses. One way or the other we always give credit and in 5 years of doing this we've never had a single complaint from anyone as a result.

Really though Gamespot, was it actually that hard to get 1 minute of your own DOOM footage for that dinky little video of yours? Come on now. As an FYI, we don't have a problem with people using our footage in their videos as well as long as they're not claiming the footage belongs to them and are giving full credit. The only problem we have are full reuploads of our content, which we do have to frequently get removed due to frequent imitation channels just downloading our entire video and reuploading with exactly the same info and tags.
