BAP INFORMATION SUMMARY: (1/3) The reasons that BAP can't do anything but sue

The reason that BAP couldn't do anything but sue - TS Entertainment's atrocities during that time - We aren't resting, we won't let BAP go, TS

Please focus on the part about agency brutality and the around-the-clock schedules they had during that time. The schedule is below the comments.

For a while when it seemed like the agency saw us fans as ridiculous, we just saw our idols' faces and held it in and passed it by, but now that [I've] learned that that company TS, which said they were such a family-like company, hasn't treated our precious idols who are like family properly, as well as other worrisome points, [I] am going to write as much as I can, as much as I know to organize it.

[I've] seen articles floating up and read the comments, but the myriad assumptions of regular people who don't know anything about the situation, as well as the comments of people who will shoot arrows of blame at the members should articles about TS' rebuttal explode, so... with a heart that wants only to reveal our current circumstances and the reality of the agency to some extent to let you judge it...

-Summary-
For nearly 1.2 years, nearly 50 concert events domestically and internationally proceeded against their wills. For 3 years, without a single rest period, participated in activities both domestically and overseas. After not providing funds to the members for nearly 3 years, despite making more than 10 billion won in sales (remaining before break-even point), finally this August provided 1,790,000 won per member. With 600,000 won annually and 50,00 won monthly, could earn a better pay just by taking an average minimum-wage job.

[T/N note: 10 billion won = $10 million, 600K won = $600, 50K won = $50 USD roughly]

2. Agency repeatedly declined requests by the members for vacations, even after members went so far as to submit medical certificates (isn't this slavery....?) Had incident of a member collapsing due to exhaustion and admitted to the emergency room, only to be dragged from the hospital and forced to perform a concert. Many times hospital fees were paid personally by members, and food and other living conditions were not very good (for 2 years, 6 members lived in one narrow room with sets of bunk beds)

3. Often members were not even informed that they had planned schedules.
= these forcible schedules were made by the company without consideration for the members' health, and took place exclusively without the members' doctors with only the company's interests in mind. They just made the schedules as they saw fit and if a member said they were sick and unable to attend the schedule, they forced the members to take responsibility for all such things as event fees and litigation.
(One agency director forced them to perform by saying, "if you don't go, all of the organizers and broadcasters for the China concert will have fees and litigation and you'd better take responsibility.")

4. While not giving any media manipulation regarding donation charity events, awards both domestically and overseas, MTV EMA final selection, etc., while only focusing on grabbing overseas activities that could earn money, didn't even give BAP the opportunity to appear at domestic locations by unilaterally cancelling all relationships with domestic broadcasters.

5. A questionable promotion cost of 1.5 billion won.
Because it was going into the personal account of the CEO, found the account statement but did not make it public. A matter of suspected embezzlement. When did a company that can't even do media manipulation say they would give an advertisement... Only during 1004 activities did they give any kind of billboard, banner ad, etc., and even if they grabbed ma~any, there was only the opportunity for approximately 300 million won of promotions.

6. Site/record sales revenue sharing method was net income only, an improper ratio of 1(BAP):9(TS).
From the 3rd full-length album they said they would do an upward adjustment to 2:8, but usually idols only get to their 3rd full-length album after 5 years or more of activity, and if you only make it to 2 full-length albums then for your entire life it will go unadjusted and remain at 1:9. In 3 years, of the 11 albums that BAP has released, only 1 has been a full-length album.

7. An extremely long contract period compared to the industry standard from the first album release date.
The contract period increases in proportion to time spent on military service or any 30-day+ period of inactivity due to personal reasons such as hospitalization. That is, longer than 7 years. Although legally showbusiness contracts can be only 7 years from the date of their start, BAP are in a situation of having a 7 year, 10 month contract. If we go along with this content then it looks like they'll just be forced to work for the rest of their lives without even one rest. (Isn't this a slave contract........)

8. In the case of having an unhealthy relationship with the opposite sex (love prohibition) or terminating the contract, forced to pay huge indemnity costs to the agency.
Based on the time of contract termination, 2 months of average monthly revenue X the amount of time left in the contract period. If they want to terminate now, then they'd pay 14 billion won.

[EMBEDDED IMAGE: Proof about the promotional costs going straight to the CEO's personal account.]

The reason why BAP is like Buddha
They're suing because out of 10 billion won earned they were only given 50,000 won per month, but even if they were paid 300 million won per month they still would have sued
(Even if you share it among 6 people it's 50 million won, accounting for 3 years of work that's less than an average office worker makes)
Meanwhile the members, who receive 50k per month, still donate (even while not getting a single payment over their 3 years of work)
Haven't said a single word over SNS about the company's injustices (have only weakly shown that things are hard)
For 3 years without a sound have done all the work that their company forced on them
And even so, every time they receive an award they thank all the workers at their company

(2011.11.27)
First, I want to thank BAP who have tried so hard to show the best stage to their fans, even while being disadvantaged by suffering an unfair contract and performed to the end even in a worsening state of health.

The ripples of slave contracts and litigation that have burst out today... to be honest there were tabloid articles that hinted at it as early as last May, so there might be many fans who have already guessed.
I am the original writer of the tabloid(?) article from last May.

From EXO's Kris to Group A... Is the "litigation wind" blowing in the entertainment industry?
The entertainment industry of Korea is expected to be stained once more with the lawsuits from exclusive contracts. Recently, according to many stakeholders in the industry, a group that has been attracting much attention from Hallyu has, with their agency...

When the contents of this article first came out, it wasn't just fans that noticed it, but other idols' fans and regular people as well,
so there were many people who guessed that it was BAP, and now with this current litigation it has been revealed that the subject was indeed BAP.

BAP's lawsuit, something which was foreseen 6 months ago... Missed the golden time for closure
"BAP's revolt" was foreseen. On this past 26th, BAP filed an injunction against their agency, TS Entertainment, for nullification of their exclusive contracts. Currently the judge to be in charge of the case is being assigned...

[IMAGE: http://mblogthumb4.phinf.naver.net/20141128_123/thewindy2_1417173565265rw8gz_PNG/122222222.png?type=w2 // highlighted: "Of course, TS Entertainment knew about this situation."]

In other words, TS Entertainment (hereafter TS) already knew about the source of the feud with the BAP members, and had plenty of time and opportunities to resolve it,
but instead forced the members to participate in concerts and overseas activities and resulted in their health states declining even further.

During that time, the fans were sympathetic to the fact that BAP's members were in poor health.
Because they were forced to participate in schedules without resting or a break for 3 years time, it was obvious that their bodies and hearts were tired.
It was to the extent that even the fans asked them to stop promoting and to take a break.
But as if the fans weren't enough, even the singers themselves asked for a break due to health problems, but were ignored and contrarily given more severe schedules and forced into more activities.
With the exception of holidays like Seollal and Chuseok, the members could not be sure that they would have sufficient rest time.

In particular, in September one or two members' health condition had become so bad that the fans noticed and became very worried.
However, although the agency was well aware that the members' health was not good, they continued to grab schedules and force them to work.
If you look at fan photos or fancams starting from September of the members coming to or leaving events,
they are full of one or two members stumbling on the way or holding their heads down as they walk.
These serious health problems' symptoms had appeared to the extent that they were visible to the fans.

I have nothing but thanks and sorrow for the members of BAP who, nevertheless, tried their hardest to show a perfect stage whenever they were standing in front of fans.

(The day of the Changwon concert, the traces of an IV drip. Looked ill even while performing the concert)

Ordinarily, the members were unaware of the fact that they had schedules, and often felt completely uninvolved in the making of their own schedules.

It can be determined that the schedules over those 3 years were tyrannically decided without reflecting the members' opinions at all.

But even though you are already aware of the content of the case itself!! The agency doesn't know...

Rumors that you hear from underwater if you hush for a moment... The parts that even the fans know, the agency is saying that they didn't know there was litigation????? As soon as the first article about BAP's litigation arose, immediately they started media manipulation saying they hadn't heard anything about the lawsuit...

- Although they are continuing to deny that they are slave contracts,

[IMAGE: http://mblogthumb1.phinf.naver.net/20141127_32/thewindy2_1417085399377GalYS_JPEG/fd11dec0230b3030c5d69e00637c9b9b-1.jpg?type=w2 // "I tried to calculate the money that BAP has received until now

In 3 years, 1,800,000 won per person
In 1 year, 600,000 won per person
In one month, 50,000 won
If you calculate with one month as 30 days
that's 17,000 won per day

If you just get a regular part-time job, you'll get 4000 per hour
In one day that's 24,000 won
5 days/week is +/- 600,000 won"]

"They made a turnover of 10 billion won after their debut, but the proceeds per person were only 1,800,000 won per person."

If they said they received 1.8 million won for 3 years of work, then 1 year is 600k won, one month is 50k won, and one day is 17k won.
An average convenience store pay is 4,000 won hourly, daily +/- 24k won,
so during that time BAP didn't even receive the money they could have gotten working part-time at a convenience store,
but instead worked themselves to death in practice and came to stand onstage.

((Article link http://www.womennews.co.kr/news/78167#.VHb95EmweM8 ))

So where did all of the 10 billion won go, that they earned by doing 50 solo concerts and uncountable international events and concerts?
If even 10% didn't come out of that 10 billion net income, doesn't that sound exactly like a company's inability, reckless management?

- A relationship of broken confidence

[IMAGE: http://mblogthumb2.phinf.naver.net/20141128_53/thewindy2_14171746671026GALH_PNG/69.png?type=w2 // discusses future action and time period of litigation, response is that their relationship is already broken with the company and they just want to receive their dues and leave.]

Although the members tried to understand their company despite not having received any settlement in 3 years time,
the exact settlement receipt is undisclosed and the proceeds are missing, the opaque parts of the company operations are identified (such as the ridiculous 10 billion won promotional cost),
and as they always say, for social justice, the company that is "busy closing its eyes, blocking its ears, and filling its stomach" created a feeling of inflaming the unfairness,

including dragging critically ill members out of the hospital and forcing them to perform a concert, not considering the physical and mental health of the members, and treating the members like machines that create money. Disappointment in this behavior by the agency is what led to the lawsuit.

[OMITTED: TenAsia article regarding the lawsuit, as it is repeated information already translated above.]

BAP, who used to share messages of thanks and congratulations with their fans on the 100th, 200th, 300th, 400th, 500th, 600th, 700th, 800th and 900th days, not a single member uploaded anything on the most critical 1000th day, and starting on the 1000th day not a single member opened their mouth. (All of them uploaded something up until the 1000th day.)

Usually BAP is quite active on SNS, uploading various things with thoughts of their fans, but suddenly on the 1000th day, all communication is cut off. Even with their domestic and overseas fans in a state of discontent, and although the members are almost certainly monitoring the situation, they haven't (aren't able to) upload a single thing. Why might that be?

Not only domestic fans, but also international fans are curious about BAP's current situation, and judging by the comments posted every time a preview of them coming into or leaving the country is uploaded (were the members okay, how were their expressions, did they seem fine?), the fans' hearts must really hurt.

Additionally, in the agency's notifications posts, nowhere is there any mention of BAP, in actuality the members are being silent but the agency is releasing things unilaterally... saying that they reached this decision together through dialogue with the members, isn't that something that's literally unbelievable at face value?

Are we really supposed to believe that a company that forced them to work for 3 years without a break, with no attention paid to their health, is going to give them a break now and absorb all the costs from the international tour? If they're really a company dedicated to the members, then I wonder why they gave them so many forcible schedules and made things so hard for them in the first place...

The thing that worries the most is that we don't know whether the members are staying quiet by their own choice, or whether the company is imposing it on them.

A lot has happened even in this short month. If you sleep today and wake up, what other things will have exploded, it's a sense of walking on a street of ice. Fans, please soothe your trouble minds and hold on.

Even though I can't tell you who is the inside man, I ask for feedback on how I can make this convincing enough. The fans are not stupid... Until when will you "close your eyes and block your ears"... Only silence is not a solution.

Lately if you listen to BAP's songs, it sounds like the songs we loved so much about social criticisms were really created for your agency.
