Take your laws to war and you will lose first the war and then your laws. As we have lost both wars and our legal rights. This is exactly what has happened. Our rights are now being equalized with enemies we're at war with, hence you see: in the eyes of the Dershowitz Court you and the terrorist/enemy combatant are the same. Conflict and reality will not conform to Civil Liberties. The Civil Liberties will be destroyed to conform to the brutal necessities of war.


This conflict of the last decade began when the FBI stopped pursuing terrorism as an intelligence matter and proceeded against the WTC 1st bombing suspects it found in 1989 as a criminal matter. BOOM. The same dysfunctional behavior continued in the 90s. BOOM. BOOM. As a result the FBI now has formal powers during wartime. Understand that no people will live under laws that are a suicide pact..so..when the utterly inadequate criminal policing powers failed the police were given Intelligence War Powers. At times. It depends on the Judge-see the Boston Bomber captured alive. At the same time the lawyers proceeded against the military with Rules of Engagement and endless investigations of battlefield shootings. During this decade it's more routine to be denied fire support for units in battle based on the lawyers Command Post [TOC] say so than not.

In war the law falls silent. Cicero was the only one before in History to bother mentioning it, the rest didn't.

I am going to add for the Libertarians - if you're too stupid to know the difference between brutal necessities of War and Criminal or Civil Law ye shan't either win in war or keep any rights at all. Nor do you deserve either.
