The following is an analysis of the so called 'crying incident'.

In the Daily mail article from May 9th 2011,Kate McCann recalls Madeleine saying on May the 3rd:

‘Why didn’t you come when Sean and I cried last night?’ (referring to Wednesday 2nd, 2007)

Notice the key phrase:"Why didn’t you come..." -- it obviously refers, from Madeleine's point of view, to Kate (or Gerry) not being there when they were upset. It either means the parents were not home when the crying took place or were and ignored it/did not hear it.

In Kate's witness testimony, given on May 4th, it is stated that:

"She (Kate) reports only one episode where, on the morning of Thursday the 3rd, Madeleine asked the witness why she had not come to look in the bedroom when the twins were crying(on the Wednesday night). The witness states that she had heard nothing and had therefore not gone into the bedroom.."

Obviously, the "had not come to look..." refers to fact that Kate McCann was not in the bedroom where Madeleine was sleeping otherwise she would not have needed to go and look.Further, the implication of the words is that Kate did not hear anything even though she was home and therefore it wasn't from being out of the flat that caused her to not hear the crying -- this is because Kate says she heard no crying therefore had no reason to go INTO the bedroom. This logic is related to how a mother would only go into a bedroom from being in the flat herself. We can thus deduce that she was in her own bedroom with her husband Gerry as per normal sleeping arrangement as she claims i.e Kate and Gerry in one room and Madeleine and the twins in the other. Also note how the reference is only to the twins crying. But in the May 9th 2011 Daily Mail article, Kate says that Madeleine was crying alongside her brother Sean. Why a different account?

Gerry McCann, in his witness testimony on May 10th, it is stated:

"On Wednesday night, 2 May 2007......Still on this night, KATE slept in the children's bedroom, in the bed next to the window, because the deponent was snoring."

Gerry says Kate slept in Madeleine's bedroom because he was snoring. It is affirmative that Kate slept in Madeleine's bedroom because of snoring. Kate makes no mention of sleeping in Madeleine's bedroom in her witness testimony on May 4th-- infact, her words allude to the fact she was in her own bedroom and not that of the kids. Thus, there's a discrepency.

Later on, in Kate's witness testimony, given on September 7th 2007, it is stated:

"When asked if she ever slept(Kate)in Madeleine’s bedroom, she says that such happened on the Wednesday(2nd), because she was annoyed with Gerry. He ignored her after dinner when they went to the Tapas bar, which only happened that day. She decided to retaliate by sleeping in the other bedroom, in the bed under the window..."

So, on Wednesday 2nd Kate states she slept in Madeleine's bedroom, along with the twins who were also there. This is a different account to her first witness testimony where she clearly pointed to the fact she DID NOT SLEEP IN MADELEINE'S BEDROOM! Kate herself alludes to this with her own words!Further, In Gerry's first witness testimony, given on May 10th, he says Kate slept in the kids room because he was snoring. Please remember however that Gerry's first testimony was given AFTER Kate's one -- 6 days to be precise. Now Kate has added two things WHICH DID NOT EXIST IN HER FIRST WITNESS TESTIMONY : 1. She DID sleep in Madeleine's bedroom and 2. It was because Gerry had annoyed her at the Tapas bar and not because of his snoring as Gerry claimed in his first witness testimony.

But one must ask: why the discrepency? Either Kate slept in Madeleine's bedroom on May 2nd or she did not.And if she did, why the differing reasons for doing it -- snoring versus being annoyed. It's a very easy thing to remember.

In Arguido questioning of Gerry McCann, on the 7th of September 2007, it is stated:

"Concerning his wife, he says that on the Wednesday she slept in the children’s room in the bed next to the window. He doesn’t know why..."

Yet again, Gerry changes his account of events. In his witness testimony from May 10th, he states that Kate slept in Madeleine's bedroom because he was snoring. Now, on September7th, in his arguido questioning, he's not sure why Kate slept in Madeleine's bedroom. Another discrepency.

Kate McCann did not answer much in her arguida questioning from 7th of September 2007 so nothing can be said of it.

However, in her witness statement on the 6th of September 2007, it is stated:

"Regarding this night(Wednesday 2nd) she said that none of the children cried, which she would have noticed as she was in the room"

But in her May 4th testimony, she states quite clearly she was not in the room as Madeleine asked her on Thursday morning why she did not come as the twins were crying. So, which version is correct?

As we can see, these are some major discrencies and it is the McCanns themselves who raised them with their differing accounts of the same events.
