[NEWS] The court "Fine of USD17,800 if SM hinders in JYJ's activities"

The Court has decided that should SM Entertainment choose to hinder in any of JYJ's activities, they are required to pay a fine of USD17,800 or 20,000,000WON for each hindrance.

Seoul's JungAng District Court (Civil Affairs Counsel number 51 Chief of Jurisdiction Kim Dae Woong) said through an indirect coercion injunction , "It is wrong for SM to hinder the activities of JYJ, and if there is a violation, SM will be required to pay a fine of USD17,800 for each violation."

The Court, "Even though there has been a provisional disposition that the effectiveness of the exclusive contract has been on suspension on 27 Oct 2009, SM, on 2 Nov 2009, opened a press interview stating that there's a requirement to follow the exclusive contract and on 2 Oct 2010, SM sent Warner Music Korea the contents of proof and requested that they stop the production and distribution of JYJ's Worldwide album. Looking into it, there is a probability that it has hindered JYJ's activities and thus the decision of an indirect coercion injunction.

법원이 SM엔터테인먼트(이하 SM)에 대해 JYJ의 활동을 방해할 경우 회당 2000만원을 지급하라고 결정했다.

서울중앙지방법원(민사합의 제 51부 재판장 김대웅)은 "SM이 JYJ의 연예 활동을 방해해서는 안되고, 이를 위반하는 경우에는 위반행위 1회당 2000만원을 지급하라'는 내용의 간접강제명령을 내렸다.

법원은 결정문에서 '2009년 10월 27일 전속 계약의 효력을 정지하는 내용의 가처분 결정을 내렸음에도, SM이 2009년 11월 2일 전속 계약을 따라야 한다는 기자회견을 진행한 부분과 2010년 10월 2일에 워너뮤직 코리아에 내용 증명을 보내 JYJ의 월드 와이드 음반 제작,유통을 중지할 것을 요구한 사실 등에 비추어 볼 때 JYJ의 연예활동을 방해 할 개연성이 인정 되므로 간접강제명령을 내린다'고 설명했다.
